Overview
E-Discovery ResponseSM is an enhancement to the Employment Practices Liability (EPL) insurance offerings of Lexington Insurance Company, designed to cover the payroll expenses incurred by an insured company while retrieving electronically stored information requested during discovery in a covered EPL claim. Newly amended Federal Rules of Civil Procedure require companies to produce information earlier in the litigation process and make it more difficult for companies to prove that producing such data is too difficult. This has prompted many to outsource this sensitive and difficult task. E-Discovery Response supports companies’ efforts to protect their private data by reimbursing the company’s internal expenses associated with this effort.
